Terms and Conditions and The Right to CancelThese Terms and Conditions and the Right to Cancel shown at the end of these terms and conditions apply
to all sales of products and services supplied by The Metal Store (www.themetalstore.co.uk) on or after
13 June 2014. These terms and conditions and the right to cancel should be read and adhered to each time a purchase is
made. By placing an order and proceeding to checkout you agree to acceptance of these terms and conditions and
acknowledge your right to cancel. This does not affect your statutory rights. We reserve the right to amend the terms
and conditions at any time and you should read them prior to any purchase.
General
In these conditions of sale:
The 'Company' means The Metal Store (www.themetalstore.co.uk).The Metal Store Limited is
registered in England and Wales no: 05375305.

The 'Customer' means any person contracting with the 'Company' for the supply of products
These conditions may only be modified by a variation in writing signed on behalf of the 'Company' by the Managing
Director.
Supply of products
The Metal Store has a legal duty to supply goods that are in conformity with the contract and products are sold under
the express understanding that:
Personal and Business Customers
Contracts for the supply of goods or services to retail or domestic customers are governed by the Consumer Contracts
(Information, Cancellation and Additional Charges) Regulations 2013 (CCIACRs) with effect from 13 June 2014 and the
Consumer Rights Act 2015. Any customers contacting the 'Company' in the course of their business are excluded from
consumer protection legislation and are contacting the company on a business-to-business basis.
Description of Products
The customer is fully made aware of conditions of sale regarding metals and other products. We cannot guarantee that the
appearance and/or the colours of products shown on this site exactly reproduce the appearance and/or colours of the
physical products themselves. All sizes quoted and supplied are within a tolerance of +/- 3mm. All the information
contained on this website is as accurate and as up to date as possible and we cannot be held responsible for any
inaccuracies. Where a photo is shown of a particular brand of product we reserve the right to substitute a different
brand of the same or better quality than shown. Any ferrous metals provided may have some rust on them, this is the
natural atmospheric oxidation of steel surfaces and we cannot be held responsible for any rusty patches. All our steel
is kept dry inside to reduce any possible oxidation.
Liability
We are sure you will appreciate that the handling of steel can be dangerous and that the edges of metal may be sharp. We
ask that customers take care handling material whilst using/fitting our products. Please use appropriate personal
protective equipment including but not limited to gloves, gauntlets, armbands, hand pads, thumb guards, gaiters,
leggings, head protection and face visors, to ensure safety at all times. Please note the edges of the sheet metal that
we sell (for example but not restricted to: mild steel sheet, galvanised sheet, zintec sheet, stainless steel sheet,
stainless steel splashback, stainless steel mirror, unbreakable mirror, stainless steel magnet board, magnetic boards,
aluminium sheet) are NOT buffed or finished, they are only deburred. Lengths of material we sell that are cut down are
not deburred. It is the customer’s own responsibility to ensure that they are satisfied with the finish prior to
using, fabricating or fixing any of our products. In no event will we be liable for any loss or damage including without
limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from the use of any of
our products.
Age Restrictions
Age restrictions apply to some goods we supply. By ordering these goods you are confirming you are over 18 and that the
person receiving the goods/delivery is also over 18. These can only be purchased if you satisfy the legal age
requirement for the product which is shown on the relevant page of our website. We are not allowed by law to supply
these products to you if you do not satisfy these age requirements. If you are underage please do not attempt to order
or purchase these products. By ordering and/or purchasing these products you agree that you satisfy the legal age
requirements for these products. We reserve the right not to supply any age restricted products where we reasonably
believe you are below the legal age for the products. To make sure we are keeping to the law we may we may occasionally
have to ask you to provide proof of age (either in person, by email, fax or post).
Orders and Quotes
You can contact us and place your order over the telephone. If you place your order via our website or over the
telephone we will email you an order confirmation complete with any cutting instructions within 10 minutes of placing
the order. We appreciate that ordering goods is a two way process between our customers and the company and endeavour to
ensure orders are correctly interpreted but occasionally there may be miscommunication. We will do our very best to make
sure your order is correct but as part of the process it is your responsibility to check the order confirmation we send
to you by email to ensure that you are satisfied and notify us within 2 hours of any changes required. If you have not
notified us withing 2 hours of your order being placed it is deemed that the order is correct and we cannot be held
responsible if your order is wrong. Should we send you a shopping cart quotation or an email with a quote on, it is your
responsibility to ensure that we have interpreted your requirements correctly. If you have received a shopping cart
quote which may or may not include cutting instructions and you have paid online, once you have paid for your order it
is deemed that you have accepted our recommendations and we will not be liable for any claim for incorrect sizes or
cutting.
We are more than happy to quote you for any material you require. If you request a quote from us we would advise you
that this is a quotation service only and is subject to the information provided to us being accurate. The Metal Store
will not accept any liability for any loss or damage including without limitation, indirect or consequential loss or
damage, or any loss or damage whatsoever arising from the use of the free quotation service or any errors and omissions
in the quotation. Fitting of our products including handrail and tube clamp products is entirely at your own risk and we
do not provide a fitting service. The ultimate responsibility for the correct choice of size and type of product or
fitting for any application belongs with the customer. The customer is responsible for ensuring that any construction or
structure is sufficiently strong to support the weight of any component parts plus any applied load and that suitable
fixings are used. Customers must satisfy themselves that the structure and its component parts are fit for purpose. The
Company reserves the right to refuse to supply any order or to supply a quotation without giving a reason.
Errors
Should we have inadvertently listed a product at an incorrect price due to an input error or an error in pricing from a
stockholder or supplier, we reserve the right to change or amend this price and to withdraw, cancel or refuse orders
even if the order is confirmed. Should this be the case we will always contact you to inform you and advise you of the
correct price. If you no longer wish to purchase the goods and have already paid for the product we will refund your
purchase by the same method as the original payment was made.
Ordering and Payment
All orders with the exception of special items, made through our website should be paid for by debit card, credit card,
or PayPal. Should you order any special items you will be sent an invoice by email, which can be paid through PayPal who
accept all credit and debit cards. Once we have received payment confirmation from our Bank your order will be
processed. We can also accept payment by the following methods; BACS; you will need to contact us on [email protected]. for details. Once we have received confirmation
from our bank that the payment has been received we will dispatch your goods. Cheque; if payment is made by cheque you
should be aware that there is a 7 day lead time from receipt of your cheque and the goods will not be dispatched until
we have received confirmation from our bank that your cheque has cleared. Paying online by debit or credit card: if the
billing address you supply does not match your billing card address and your payment is subsequently declined, your bank
may put a temporary hold on the transaction amount. This hold should be cleared within 30 minutes to a day, depending on
your bank, we are unable to release any hold placed by your bank. Your money will NOT have been taken by The Metal Store
and we advise that you do not attempt to retry a declined transaction and instead contact us by phone 01274 875479 to
pay for your order by other means.
Please note we are unable to accept PayPal payments for any products that are to be collected.
We would advise you that we do not store any credit/debit card details or any financial information supplied to us once
you have paid for your order.
PayPal Payments & DeliveryIf paying by PayPal it is the customers' responsibility to ensure that
the address registered with PayPal is the correct address for the delivery of any orders. If the address held by PayPal
is different to the delivery address, you should contact us immediately to advise us of the correct delivery address.
The Metal Store does not have access to customers' PayPal accounts and are unable to amend any of the details. If we are
not advised of the correct delivery address then The Metal Store reserves the right to charge for the re-delivery of any
goods sent to the wrong address. The Metal Store will not be responsible or be held liable for compensation for any
losses, damages, charges or expenses as a result of any delay of delivery or delivery to an incorrect address.
Availability
Should for any reason the product not be available for immediate delivery you will be contacted with an estimated date
of delivery. Should the date not be acceptable and you wish to cancel your order and you have paid, your payment will be
refunded including any delivery charges (except for the supplementary costs arising if you chose a type of delivery
other than the least expensive type of standard delivery offered by us). Refunds are made by the same method as the
original payment was made.
Delivery
All goods are delivered to the address stated at the time of ordering. We aim to deliver your goods if they are in stock
as soon as possible within approximately 2 to 3 working days (this is only an estimate and may be
sooner or no more than 30 days after you have placed your order). Our products are sent out in good faith and
occasionally goods are misrouted, lost in transit or may be subject to delays beyond our control. If the
contents of your parcel are for installation on site, we do not recommend you schedule any work or book any
contractors until you have received and checked the goods. We can not be held responsible or be liable for any losses,
damages, charges, compensation or expenses as a result of any delay in delivery. Our standard delivery is
between 8.00am to 6.00pm, (these times are estimated only and delivery may be earlier or later than shown) Monday to
Friday. Standard delivery includes our free delivery service. If we do not have your item(s) in stock or our
stockholders are out of stock there may be a delay of up to 30 days. Should this be the case we will contact you by the
email address you provided at the time of ordering and advise you accordingly. You will have the option of cancelling
your order and any payments including any delivery charges (except for the supplementary costs arising if you chose a
type of delivery other than the least expensive type of standard delivery offered by us), will be refunded. We will not
refund the original delivery cost or the cost of us delivering the goods if you received free delivery. Refunds are made
by the same method as the original payment was made.
Delivery by Haulier
Occasionally we may ship your goods by haulier, this is usually if you order bundles of tube, or very heavy items. If
you refuse the goods at the time of delivery you will be required to cover the cost of the original transportation to
you and the return cost back to us, this will be deducted from any monies to be refunded.
The Metal Store sends all goods out in good faith. We would advise you to accept and check any deliveries within 48
hours of receipt and contact us on 01274 875 479 immediately if you believe there are any damages, errors or omissions
with the order and we will arrange to rectify this. Should any parcels have obvious damage, please sign the carriers
proof of delivery as DAMAGED. Failure to report shortgages or damage within 48 hours means that we can not raise a claim
with the carrier and may result in your claim being refused. If you refuse a delivery for any reason, we reserve the
right not to dispatch any further goods until the refused delivery has been returned to us. We also reserve the right to
charge for any further deliveries. Each query regarding deliveries will be assessed separately.
Please note: If you have ordered some cut tube, i.e. 1 x 6 metre length cut into 2 x 3 metre lengths
they may be delivered placed end to end in the package and therefore, this may seem that the tube has not been cut.
Please check the package prior to contacting us.
We reserve the right to apply additional delivery charges on orders that are heavy, long or being delivered to an
offshore address. We will contact you on receipt of your order if any additional charges apply prior to the order being
dispatched.
Delays
As with all deliveries, occasionally your parcel may be subject to delays beyond our control. If the contents of your
parcel are for installation on site, we do not recommend you schedule any work until you have received the goods. We can
not be held responsible or be liable for any losses, damages, charges or expenses as a result of any delay of delivery.
Force Majeure
The company is not liable for any delay of your order due to circumstances beyond our control. These include but are not
limited to an act of God, war, terrorism, strikes, trade disputes, breakdown of equipment, fire, flood, explosion,
earthquake, civil disturbance, riots, accidents, storm, shortages, difficulty in obtaining material, disruption to
energy supplies, telephone supplies, road traffic problems, severe weather conditions.
Receipt of goods
All packages are thoroughly checked and wrapped before leaving our premises and are delivered to you by our carriers.
Once the goods have been signed for we accept no responsibility for any loss or damage as the goods are now in your
possession. On receipt of goods, please check your package carefully, should your goods or the packaging be damaged or
items are missing the carriers delivery note must be signed DAMAGED or MISSING ITEMS. If this is the case you should
contact us as soon as possible, within 48 hours, so we can investigate and resolve any queries, either by email on [email protected] or on our telephone support
number 01274 875 479. All claims for wrong, faulty, damaged or missing items must be submitted within 48 hours of you
receiving the goods, please take photographic evidence if possible showing any damage to packaging and the contents
inside, by contacting us quickly it allows us to investigate and resolve any issues. Failure to report damage and
shortages within 48 hours may result in your claim being refused and all goods will be deemed to have been delivered in
good order. Please also note the following:
If the goods are delivered damaged we may require evidence of the damage, e.g. photographs before we replace the
goods or make a refund. Please contact Customer Services on 01274 875479 to discuss.
If your goods are delivered damaged we will replace them or make a refund providing that the goods have not been
used. If the goods have been used they will be deemed fit for purpose and we reserve the right not to replace or
make a refund.
If your goods are delivered damaged we reserve the right to collect the damaged goods from the delivery address
stated on your order.
If the goods are to be collected this may be on a different day to any replacement goods being delivered.
Refused Deliveries
The Metal Store sends all goods out in good faith. We would advise you to accept and check any deliveries received and
contact us on 01274 875 479 immediately if you believe there are any errors or omissions with the order and we will
arrange to rectify this. If you refuse a delivery for any reason, we reserve the right not to dispatch any further goods
until the refused delivery has been returned to us. We also reserve the right to charge for any further deliveries. Each
query regarding deliveries will be assessed separately.
If you refuse delivery of the goods, The Metal Store reserve the right to charge you for the cost of the goods being
returned to us by our carrier.
Please note: If you have ordered some cut tube, i.e. 1 x 6 metre length cut into 2 x 3 metre lengths
they may be delivered placed end to end in the package and therefore, this may seem that the tube has not been cut.
Please check the package prior to contacting us.
Redelivery
If your package is returned to us undelivered, we will not be held responsible or be liable for any compensation for any
losses, damages, charges or expenses as a result of any delay of delivery. We may charge to redeliver the parcel to you.
Collection
If you would like to collect your goods from us to save on carriage costs, please contact us first before making any
journey to ensure your goods are ready to collect. We cannot be held responsible if you arrive and the goods are not
ready. Please note that goods paid for through PayPal cannot be collected. We would also advise you that unless goods
have been paid for prior to collection any cutting required will not be carried out until you arrive and the goods are
paid for. Therefore, you may have to wait for your order.
Faulty or Wrong products
Please be aware that all our packages are quality control checked before leaving our premises to ensure any potential
problems are minimised. Should you be in the unfortunate situation that you have received the wrong goods or they are
faulty, please contact Customer Services on 01274 875 479 or by email on [email protected] All faulty goods should be
returned to us within 14 days of receipt of your order. Please contact Customer Services by email on [email protected] before returning any goods
to obtain a returns number. Please also note the following:

collection or no-show by our couriers.
Returns
We will refund or exchange an item, providing that:
You have 14 days to cancel your order from receipt of the goods.
You shall send back the goods or hand them over to us at The Metal Store, Brook Mill, Hightown Road, Cleckheaton
BD19 5JS, without undue delay and All returns MUST be made within 14 calendar days of you telling us that you are
cancelling your order. For example if you told us on Monday 1st of January that you were cancelling your order you
would then have until Monday 15th of January to return the goods to us.
The deadline is met if you send back the
goods before the period of 14 days has expired.
If you wish to return an item for any reason except being faulty or we have sent the wrong goods we will only
accept items that are on our current stock list. Any steel that has been specially cut to your size/requirements
cannot be returned.
Stainless steel splashbacks are cut to customer's specification. Therefore, we are unable to accept return unless
they are damaged, faulty or we have sent the wrong goods. Once the splashback has been cut we are unable to cancel
the order even if the goods have not been dispatched.
Once your order has been cut to your requirements we are unable to cancel the order even if the goods have not
been dispatched.
Unless the products are faulty or we have sent the wrong goods, we are unable to accept returns of roofedge
protection systems as these products are designed on an individual project basis.
We are unable to accept return of powder coated products unless they are faulty or we have sent the wrong goods.
We are unable to accept return of blackened tube clamp products unless they are faulty or we have sent the wrong
goods.
We are unable to accept return of Copper & Brass effect clamps unless they are faulty or we have sent the wrong
goods.
We are unable to accept return of any of our Tube Clamp kits as these are cut to order, unless they are faulty or
we have sent the wrong goods.
If you have ordered powder coated products and cancel your order prior to the goods leaving us you may be charged
for this service if we incur costs for this process.
It is at our discretion to refund any returned items that are part of a pack. For example if you purchased a pack
of 50 tube connectors, have used 20 and return 30, we reserve the right not to refund you for the 30 you have
returned. If we do refund any returned products that are part of a pack the refund will be at the cheapest unit
price of the product shown on our website.
If you wish to return an item to us please contact Customer Services on 01274 875 479 or on [email protected] BEFORE returning any
item, who will discuss this with you.
We are sorry but we cannot accept returns of specially made items i.e. laser cutting or plasma cutting as these
have been made to your design.
Please be aware that should you wish to return an item for any reason other that it being faulty or we have sent
the wrong goods you will need to arrange for the goods to be returned to us either by post or courier and this will
be at your own cost.
If you paid for your original delivery we will refund the original delivery cost to you (except for the
supplementary costs arising from Pre 9am, Pre 10.30am, AM, Saturday AM, Saturday or other Premium delivery costs offered by us). We will not refund the original delivery cost or the cost of us delivering the goods if you received
free delivery.
Any items to be returned should be in the original packing and be unused. We will not accept any items that have
been used, cut, damaged and are not in a re saleable condition.
We reserve the right to recover any amount up to the contract price of any items returned to us in a damaged state
or if the value of the goods is diminished by any amount as a result of you handling the goods beyond what is
necessary to check the nature, characteristics and functioning of the goods.
All returns must show on the outer packaging our returns number. Our Customer Services team will give this to you.
Any refund will only be made once we are in receipt of the goods or you have supplied evidence of having sent the
goods back whichever is the earliest. Any refunds are made by the same method as the original payment was made. We
aim to process your refund as soon as possible but this will be within 14 working days of receipt of the returned
goods or if earlier 14 days after the day you provide evidence that you have returned the goods.
If you return goods to us for a refund, we reserve the right to deduct or adjust any discount applied at the time
of ordering. If the value of the returned goods brings the value of the original order under the discount threshold,
all discount will be deducted from the refund as the order no longer qualifies for discount, if the returned items
reduces the original order value into a lower discount category, the value of the refund will be adjusted by the
difference in discount category value. We apologise for any inconvenience this may cause but we have had to
introduce this condition due to some customers over ordering to qualify for discount and then returning goods to us
for refunds.
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCIACRs) form part of
our refund/exchange policy. If the product you ordered is no longer required and provided that we have not
personalised these goods by cutting them down to your specific sizes, they are not powder coated, blackened tube
clamps or roofedge protection systems, this allows you to cancel your contract with us within 14 working days of
receipt of the goods. This only applies to transactions that are not Business-to-Business. If the goods are not
required you will need to arrange for the goods to be returned to us either by post or courier and this will be at
your own cost. Please see Your Right to Cancel section shown at the end of these
terms and conditions.
This refund policy does not apply to sourced goods, please the Sourced Goods Section for further information.
Goods lost in transit
Please allow 7 working days for goods to be delivered once you have been notified that they are in transit to you. If
after this time you have still not received your goods, please contact us within 7 days of the expected delivery date
for us to investigate. Should you not contact us by email on [email protected] within this time frame, it
is expected that the goods have been delivered in good order and no claim will be entertained.
Sourced Goods
We will try source any goods you request of us by using our contacts within the industry. Any goods supplied by us will
be under contract and a quantity and price will be agreed by both parties before any orders are placed with our
suppliers or accepted. In this situation should the goods be faulty we reserve the right to negotiate with our supplier
before any credits are agreed with our customer. This may be outside the 14 day time frame stated in these terms and
conditions but we will do everything possible to keep time limits to a minimum. Any special sourced goods are
non-returnable unless the product is faulty.
We appreciate that ordering goods is a two way process between our customers and the company. We endeavour to ensure
orders are correctly interpreted but occasionally there may be miscommunication. We will do our very best to make sure
your order is correct but as part of the process we also ask you to check the confirmation we send to you by email to
ensure that you are satisfied. We cannot be held responsible if you do not inform us immediately of any changes prior to
us placing any orders with our suppliers.
Powder Coating
If you have ordered powder coating and you cancel your order we will try to stop the process. However, please note, that
if we have incurred any costs these will be chargeable. Also, please be aware that we are unable to accept the return of
powder coated products unless they are faulty or we have sent the wrong goods.
Customer Services/Complaints
We pride ourselves on our Customer Service and we are available during office hours to speak to if you have a query, are
not sure of the product you need or you have any comments or cause for complaint. We aim to resolve all queries/issues
within 24 hours but please appreciate sometimes this may take slightly longer. We will help to resolve any problems you

It is at our discretion to refund any returned items that are part of a pack. For example if you purchased a pack
of 50 tube connectors, have used 20 and return 30, we reserve the right not to refund you for the 30 you have
returned. If we do refund any returned products that are part of a pack the refund will be at the cheapest unit
price of the product shown on our website.
This cancellation period will expire after 14 days from the day on which you or a third party other than the
carrier and indicated by you acquires physical possession of the goods.
To exercise the right to cancel you must inform us, of your decision to cancel this contract by a clear statement,
in writing either by:
post to The Metal Store, Brook Mill, Hightown Road, Cleckheaton BD19 5JS,
You may use the model cancellation form shown at the end of this information if you wish to do so but this is not
obligatory.
To meet the cancellation deadline it is sufficient for you to send your communication concerning your exercise of
the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract we will reimburse to you all payments received from you including the costs of
delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive
type of standard delivery offered by us). We will not refund the original delivery cost or the cost of us delivering
the goods if you received free delivery.
We may take a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result
of any unnecessary handling by you; other than any handling beyond what is necessary to establish the nature,
characteristics and functioning of the goods.
We will make the reimbursement without undue delay, and not later than:
14 days after the day we receive back from you any goods supplied, or
if earlier, 14 days after the day you provide evidence that you have returned the goods or
if no goods supplied, 14 days after the day on which we were informed about your decision to cancel this
contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you
have expressly agreed otherwise; in any event you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent
the goods back whichever is the earliest.
Returning Goods
You shall send back the goods or hand them over to us at The Metal Store, Brook Mill, Hightown Road, Cleckheaton
BD19 5JS, without undue delay and All returns MUST be made within 14 calendar days of you telling us that you are
cancelling your order. For example if you told us on Monday 1st of January that you were cancelling your order you
would then have until Monday 15th of January to return the goods to us.
The deadline is met if you send back the
goods before the period of 14 days has expired.
You will have to bear the direct cost and arrange to return the goods by post or courier.
If the goods by their nature cannot be returned by post you will need to arrange their return by courier and this
will be at your own cost.
